By accepting these Terms you agree to use the Website and the services available therein, in the manner and form that it itself established. You are obliged not to use this Site and its services for illicit purposes and/or contrary purposes to the ones specified in these Terms and Conditions, which could damage the rights and/or interests of others or in any way damage the Website or preventing it or its services available currently or in the future to work properly.

4. SCOPE OF THE SITE. USER’S OBLIGATIONS:

Pomerania Kids reserves the right to withdraw unilaterally and at any time and without notice links that may appear on its site. Pomerania Kids reserves the right to prevent or prohibit access to the Site to any Internet user that posts any content contrary to legal or moral rules on the Site, reserving the right to take any legal action deemed appropriate to prevent this type of behaviors.

Nor isn't it responsible that the content or software that can be accessed through such Site is free from errors or cause any damage. In no event Pomerania Kids will be liable for losses or damages of any kind arising from access and use of the Site, including but not limited to those caused to computer systems or those caused by viruses. Pomerania Kids is not responsible for any damage that may occur to users for misuse of the Site. In particular, it's not responsible in any way for breakdowns, interruptions, faults or defects in telecommunications that may occur.

Pomerania Kids SL guarantees maximum security and confidentiality in the processing of the personal data of our customers. Only the personal data for billing and shipping of merchandise will be requested. Pomerania Kids SL does not store customer bank data. 

The processing of personal data and transfer of communications through electronic means are adjusted to the regulations established in the Organic Law 15/1999, December 13th, of Protection of Personal Data (B.O.E 14/12/1999) and the Law 34/2002, July 11th, of Services of Information Society and Email (B.O.E. 12/07/2002). 

In addition, except as expressly opposition, any companies part of Pomerania Kids SL will have access to your personal data any, exclusively for the purposes described above. The User agrees not to remove or alter any distinctive sign used on the Site, such as but not limited to trademarks, trade names (graphics, logos, etc.), the "copyright" and other data identifying the rights of Pomerania Kids or other owners appearing on the Website.

Likewise, it's property of Pomerania Kids all rights over any works, inventions, discoveries, patents, ideas, concepts, updates and improvements related to the Site, its systems, applications and programs or services provided by Pomerania Kids, which are created, produced, developed or implemented for the first time by Pomerania Kids, either alone or with the help of users of the Site, during or as a result of any design, development or any other activity performed in accordance with the Contract.

The User may not use the name or trademarks, symbols, logos or distinctive signs property of Pomerania Kids without the express written consent of the latter.

11.- JURISDICTION AND APPLICABLE LAW

The Rules of Use found in this Legal Agreement are governed by Spanish law. Both Pomerania Kids SL and users of the Site agree that any dispute that may arise regarding the interpretation, compliance and/or implementation of these rules shall be expressly subject to the jurisdiction of the competent Judges and Courts of Madrid Capital, with express waiver of any other jurisdiction that may apply.

12.- RETURNS RESTRICTIONS

Pomerania Kids will not be responsible of items retained by customs due to a lack of documentation. We recommend to our customers that want to do returns using a courier with tracking.

If your return do not not accomplish our return policy terms we will contact you and you can ask to return back the item/s assuming the related costs (shipping, taxes, customs...). If you do not accept this option Pomerania Kids reserve to retain merchandise and amounts from the products purchased.

- RETURNS:

We would recommend that you return your items via registered post. Please clearly state in an e-mail to: info@pomeraniakids.com your order reference, item/s to return/exchange and the reason for return and whether you require a refund, credit or exchange for authorization. Some goods are non-returnable for hygiene reasons. We do not accept returns from our Outlet (Reduced price products without "New" label) special requests from our customers and non authorized for return merchandise.

Shipping and return costs are not refundable. Orders sent through certified mail will receive credit from store, only express shipping orders are eligible for refunds. The item/s need to be returned back to us within fourteen (14) days since delivery date. However you will be responsible for the cost of returning the goods to us. If a refund is payable to you we will process the refund as soon as possible, and, in any case within fourteen (14) days.

You have a legal obligation to take reasonable care of the goods while they are in your possession, keeping the products in the same conditions that were sent. (Original packaging, boxes, labels...etc). Any non-faulty items that are not in a condition suitable for resale (i.e. used, washed, soiled or damaged), will not be refunded and will be sent back to you. Pomerania Kids will refuse returns arriving out of the return period (14 days since delivery date).

If you return goods claiming they are defective, we will examine the returned goods and will notify you of your refund via e-mail within a reasonable period of time. We will process the refund due to you as soon as possible.

If a refund or reimbursement is payable to you, we will transfer the money using the same method originally used by you to pay your purchase.

EXCHANGES:

If you need an exchange for another size or item you should place another order with the desired item and send us the other product. Please send an e-mail to: info@pomeraniakids.com with your request.
